FROM THE EDITOR
The   German    American
Law Journal is designed
to further the exchange of
ideas  and     to  discuss
issues of interest to the
German-American      legal
community. As      further
steps toward this objecti-
ve, the authors in this
issue   explore   matters
that we think will widen
the perspectives of a Ger-
man-American legal prac-
tice.
Accordingly, Robert Lud-
wig addresses an issue of
fundamental concern to
German-American      com-
mercial intercourse. Ex-
port controls have been
treated by many German
companies with a cavalier
attitude which justifiably
evokes criticism in the
United States. They have
found hard to accept the
fact that export controls
travel   with   U.S.-made
products. Since at least
1985, German companies
have stated that they will
look for other suppliers if
U.S. products remain en-
cumbered with quite agg-

ressive U.S. export con-
trols, as sensible as these
may seem from a U.S.
perspective. I remember
vividly the booing I recei-
ved as a speaker in Berlin
when    I  explained   the
effect of U.S. reexport con-
trol law   on  Germany's
computer    industry    in
1988.
This case study emerges
from that background. An-
other facet of that back-
ground reflected in the
article is that for many
years, the Commerce De-
partment's administrative
law judges appear to have
feuded with the Under Se-
cretary for Export Admi-
nistration over their alle-
gedly misguided insisten-
ce on the rule of law.
Turning to other articles
and contributions, litiga-
tors and software addicts
will want to look at Ge-
rald Deck and Andreas
Schmidt's evaluation    of
Objection! Those of you
who need to fulfill Cali-
fornia CLE requirements
can earn credits with this
serious,  humorous    and
challenging game.

I recommend Objection! to
anyone who has become
rusty on evidence and is
bored with L.A. Law.
Andreas Schmidt's report
on a seminar dealing with
crime in eastern Germany
and Robert Ludwig's con-
tact service for speakers
at meetings in Germany
supply the German com-
ponents to this issue.
Peter Pfund updates us
with an interesting and
encouraging report on the
Hague Convention for the
return  of children. He
reveals a pleasant sur-
prise. Heike   Gramckow
shares insights into new
European Community po-
licies on the environment.
As always, the German
American Law Journal
remains open to contribu-
tors who are considering a
forum in which to address
fundamental    issues  in
academic style, but the
Journal will also provide
space for tidbits from our
work lives that may in-
terest a larger audience.
