Is Real Life Finally Happening?

This comment is the text of Toni Pickard's orientation address to students
entering law studies at Queen's Faculty of Law. The author argues that
attending law school is as much a part of real life as living in city ghettos. Real
life is always happening - anytime and anywhere that life is being lived.
She then analyzes how the hierarchical structure of legal education induces
conformity, lack of engagement, and a sense of unreality. Intimidated students
tend to withdraw, depreciate their personal knowledge, and feel that they risk
inadequacy to express their own perceptions. These processes of domination
reinforce the masculist, white, middle class, heterosexual values of the legal
profession, and ultimately, of legal doctrine itself. Toni Pickard concludes
that the resulting dominant culture will be challenged only when law
students and lawyers recognize the effects of hierarchy and mainstream
dominance, listen to those who speak from the margins, draw on their own
experiences of marginalization as a resource for learning empathy, and begin
to care about the entire community.

de l'Universit6 Queen's. L'auteure y soutient que la frequentation d'unefaculte
de droit fait partie de la vraie vie au meme titre qu'habiter un ghetto urbain.
L'important, c'est ce qui est vecu, peu importe le temps ou le lieu. Elle analyse
ensuite comment les structures hi~rarchiques induisent la conformitM,
l'absence d'engagement et le sens du reel. Les 6tudiant(e)s, intimide(e)s, ont
alors tendance 6 avoir une image negative d'eux-memes et n'osent pas
exprimer leurs propres perceptions. Ce processus de domination renforce les
valeurs masculines qui sont v~hiculees au sein de la profession et influence la
doctrine elle-meme. L'auteure conclut en disant que cette culture dominante ne
changera que si les etudiant(e)s en droit et les juristes en percoivent les effets
negatifs, se mettent d l' coute des marginaux et se pr~occupent de la
communaut6 toute entiere.
