ury verdict reports are an important resource for trial attorneys. However, while trial attorneys are the most obvious
users of verdict reporting services, they are not, and should not be, the only ones to use the valuable data found in
these reports. Jury verdict reporting services should also be important tools for general counsels.
Just as these services are important to trial attorney, jury verdict reports are a tool for in-house attorneys to consult when
deciding whether to initially settle a case or, perhaps, to hire an outside litigator. In this article I will discuss some of the
nuts and bolts of jury verdict reporting services and what it is about them that makes them so useful.
It should be noted at the outset that my using, as examples, particular services throughout this article should not be
viewed as an endorsement of those products or services. Any mention of a product or service by name is for illustration pur-
poses only.
What is Reported?
First, let me state up front, jury verdict report is somewhat of a misnomer, for many of these services contain much more
than jury verdict data. Many also include reports of bench trials and settlements, two instances that are distinctly antithet-
ical to jury verdicts. In each of those cases, however, the facts and circumstances of the bench trial or the settlement provide
insight to a jurisdiction's jury practices. Settlements, for instance, are presumably reached to avoid a jury trial, and, there-
fore, the amount of settlement is in some way indicative of expectations of awards from a jury. The fact of a bench trial indi-
cates that the parties avoided a jury trial for some reason, perhaps because juries in the reporting jurisdiction are
unpredictable in the types of actions that were at issue.
