AN   INTERVIEW WITH GARY S. KATZMANN


Editor's note: Mr. Katzmann teaches a course on the
Government Lawyer at Harvard Law School. He is also
Chief Legal Counsel at the U.S. Attorney's Office in
Boston. This interview was prompted by his recent book

Q. Who  is your audience for this book?

A. Law students, college students, criminal justice
programs, lawyers both in the defense and prosecu-
tion bars-anybody who wants an inside view of the
criminal process.

Q. How  did you come to write this book?

A. This book  grew out of a course on criminal
justice and law enforcement I taught at Harvard
Law School. I discovered that while many texts pre-
sented a view of criminal justice through the doc-
trinal lens of the judicial decision, there was no
book I could assign to students which examined the
journey of a case in terms of everyday concerns of
institutions, policy, and strategy. Inside the Criminal
Process seeks to do that.

Q. What  does your book  cover? For instance, I
found  the inclusion of court forms, such as the
grand jury subpoena, much  more  effective than
simple narrative.

A. It tries to explain the inner workings of the
criminal process: investigative techniques (includ-
ing undercover operations and the use of infor-
mants), grand jury proceedings, the decision to
prosecute, arraignment, pretrial release and pre-
trial motions, trial (including jury selection, open-
ing statements, evidence, closing arguments, ver-
dict), sentencing, appeal, and imprisonment. The
book  includes many kinds of primary material,


from raw  FBI transcripts to trial testimony and
government guidelines. I wanted to bring the proc-
ess to life for the reader.

Q. Why  no subtitle? Why not a subtitle with Ab-
scam in it?

A. While the Abscam prosecution of Harrison Wil-
liams is a thread running through it, the book
extends well beyond Abscam to explain the criminal
process. For example, it includes material on the
Comprehensive  Crime Control Act, the new federal
sentencing guidelines, the Wedtech investigation,
and the Iran-Contra situation.

Q. What role should clinical legal education play in
law school or can books like yours, and many that
you have cited in your bibliography, serve the same
purpose?

A. We do need clinical legal education to give stu-
dents a more informed  view of how our system
operates. My book can be used in clinical education
courses, standard criminal procedure courses, crimi-
nal law courses, judicial process courses, and legal
process courses, as well as in political science and
criminal justice programs. The thrust of the book is
away from the standard appellate decision approach
and toward what in fact happens in the process. For
example, what is the relationship between prosecu-
tors and investigators; when does government de-
cide to prosecute a criminal case; and what legal and
bureaucratic forces do defendants and attorneys
face before, during, and - ter trial?

Q. What  books do you recommend  to students in
law school? For instance, in terms of criminal law, I
cannot think of one book I would recommend that
law students read unless it is the recent reissue of
Rovere's Howe and Hummel.
