Penal Protection of Public Health from the Effects

of  Pollution in the UAE Federal Law

        Abstract


The UAE federal legislator is keen to protect the environment and its development by
amending the Federal Environmental Protection and Development Law No. 24 of 1999,
which provides for the penal protection of public health by criminalising any act that
damages the quality of water, air and land, or generates excessive noise or misman-
ages the disposal of hazardous substances and medical wastes. The UAE Federal Law
imposes penalties for all such violations, however without achieving the purpose of
deterrence or punishment.

1       Introduction


The subject of this analytical research is the penal protection of public health
from  the effects of pollution in light of the UAE Federal Environmental
Protection and Development  Law No. 24 of 1999. This law expresses many of
the penal manifestations generally aimed to protect public health from the
effects of pollution, particularly regarding violations leading to air, water and
land pollution, to excessive noise, or to the unsafe disposal of hazardous sub-
stances or medical wastes.
   The aims of this study are embedded in the concepts of public health and
pollution: namely, to determine the purpose of penal protection with regard to
