Antitrust Section Meets at
ABA Annual Meeting in San Francisco


   San Francisco was the site of the
 1982 ABA Annual Meeting. The An-
 titrust Section met on August 9 to 11 in
 conjunction with the ABA Annual
 Meeting. In addition to the meetings
 held by the individual Committees,
 the Section hosted a number of
 distinguished speakers and programs.

 Justice White Speaks
 The Section was privileged to hear
 the remarks of Supreme Court
 Associate Justice Byron R. White at
 the annual luncheon held on August
 10. Picking up the theme that has
 been sounded by other Supreme
 Court Justices in recent speeches,
 Justice White addressed the burdens
 faced by the Supreme Court in handl-
 ing an increasing docket. The Justice
 called the Section's attention to a
 number of proposals which had been
 tabled as possible remedies for the
 Court's congested calendar.
   Interestingly, Justice White com-
mented upon a recent suggestion that
the Court be relieved of the need to
process petitions for writs of certiorari
by the creation of a new court whose
sole function would be to grant or
deny petitions for Supreme Court
review. Justice White expressed the
view that this proposal would have lit-
tle impact upon the Court's workload,
noting that he himself gives con-
siderable attention to the certiorari
docket and does not find the certiorari
review process to be overly timecon-
suming. It will be remembered that
Justice John Paul Stevens recently
remarked to the American Judicature


Society that he finds time only to
review a small percentage of the cer-
tiorari petitions presented to the
Court.

Judicial View of
Antitrust Litigation

   As John W. Davis once remarked,
 there is no better instructor for an
 aspiring fisherman than the fish
 himself. In keeping with this precept,
 the Section was pleased to sponsor a
 program entitled Judicial Views:
 Controlling the Antitrust Case, on
 August 10. A packed house heard four
 judges express their views about
 discovery, pretrial, and trial problems
 in antitrust cases. The panelists in-
 cluded: the Honorable Patrick E.
 Higginbotham, of the United States
 Court of Appeals for the Fifth Circuit;
 the Honorable Edward R. Becker, of
 the United States Court of Appeals for
 the Third Circuit; the Honorable
 William W. Schwarzer, United States
 District Judge, Northern District of
 California; and the Honorable John
 F. Grady, United States District
Judge, Northern District of Illinois.
Although the judges reflected their
own different approaches to antitrust
litigation, their views were uniformly
enlightening. Their observations will
be recorded in a forthcoming volume
of the Antitrust Law Journal.
