INTERPRETATION OF SECTION 9(b) NEW
BANKRUPTCY LAW.
I have been asked to give my interpretation of Section 9 (b) of Public Statute
301, being our Amendatory Bankruptcy Law, and amending Section 24 (b) of
the present statute. The amendatory matter in question reads as follows:
Such power shall be exercised by appeal, and in the form and manner of an appeal,
except in the cases mentioned in said Section 25 to be allowed in the discretion of the
appellate court..
Now Section 25 has two paragraphs having to do with appeals. Under 25 (a)
it would appear that the appeals exists as a matter of right. Under paragraph
(b) the appeals are allowable in the discretion of the court. The query was.
Does this amendatory law modify the right of an appeal under 25 (a) ?
Had the amendatory provision which was inserted by the Conference Commit-
tee had the letter (b) after it, then of course it would have been perfectly clear
and explicit. Feeling that there might be some doubt and ambiguity about the
failure to insert the letter (b) after the figure 25 in the amendatory matter, I
