Act No. 82-05, respecting the prevention and settlement of collective labour
disputes. Dated 13 February 1982. (Journal Officiel, 16 February 1982,
No. 7, p. 218.)
Title I. General provisions
1. This Act lays down the compulsory procedures to be followed for the
prevention, conciliation and arbitration of collective labour disputes arising
between workers and undertakings covered by Act No. 78-12 of 5 August 1978'
to make general provision for workers' conditions of employment.
2. The expression collective labour dispute means any question that has
not been solved by means of the procedure laid down in sections 6, 7, 8 and 9 of
Title II of this Act.
3. It shall be the duty of the bodies and institutions responsible for the
prevention and settlement of collective labour disputes to help to strengthen and
develop harmonious labour relations, as defined in Act No. 78-12 of 5 August
1978, referred to above, and the regulations made thereunder.
Such bodies and institutions shall remind the parties concerned of their rights
and obligations under the legislation currently in force.
4. The bodies and institutions responsible for the prevention and settlement
of collective labour disputes may, where necessary, acquaint themselves with the
economic, financial and social situation of the undertakings concerned in
disputes.
To this end they may make inquiries with such undertakings and with the
trade union and peasants' organisations and call upon the parties to produce any
documents or information needed to settle the dispute.
They may have recourse to any public service or qualified person likely to
assist them in the performance of their duties.
5. Collective labour disputes shall be submitted for consideration and
settlement to-
the legally constituted bodies within undertakings;
the appropriate local labour inspectorate;
the ad hoc communal committee for the conciliation of collective labour
disputes;
the district (wilaya) committee for the prevention and settlement of collective
labour disputes;
the national committee for the prevention and settlement of collective labour
disputes;
the arbitration authority.
