Act No. 22248, to approve nation-wide rules governing agricultural work.
Dated 3 July 1980. (Boletin Oficial, 18 July 1980, No. 24461, p. 2.)
1. The nation-wide rules governing agricultural work contained in the
Schedule to this Act, which shall be observed as a law of the Nation, are hereby
approved.
2. The National Ministry of Labour shall prepare regulations under this Act
and shall submit them for consideration by the Government.
3. Section 2 of the rules governing contracts of employment, as approved by
Act No. 20744 and amended by Act No. 21297,1 is replaced by the following:
2. The application of this Act shall depend on the compatibility of its
provisions with the nature and characteristics of the activity concerned and with
the specific legal provisions governing that activity.
The provisions of this Act shall not apply to-
(a) persons employed by the national, provincial or municipal civil service,
except where they are expressly included within its scope or within the scope
of collective labour agreements;
(b) domestic servants;
(c) agricultural workers.
4. Legislative Decree No. 28169/44,2 Act No. 13020,3 Legislative Decree
No. 15169/56 and Decrees Nos. 2509/48 and 34147/49' are hereby repealed.
5. This Act shall be communicated, published, transmitted to the National
Directorate for the Official Archives and filed.
SCHEDULE. NATION-WIDE RULES GOVERNING AGRICULTURAL
WORK
Preliminary title
1. This Act shall govern all matters relating to the validity of contracts for
agricultural employment and to the rights and obligations of the parties, even
where such contracts are concluded outside Argentina, on condition that the
work is done on national territory.
2. There shall be deemed to be a contract for agricultural employment
when an individual does work connected mainly or subsidiarily with agricultural
activity in any of its forms, such as farming, stockbreeding, forestry or the
keeping of poultry or bees, and does so elsewhere than in an urban area as the
employee of another person, whether or not the latter carries on his activity for
purposes of gain.
Where there is any doubt as to the application of this Act on account of the
area in which the work is done, the matter shall be determined on the basis of the
nature of such tasks.
3. This Act shall also apply, even where the work is done in an urban area,
to the handling and storage of cereals, oil crops, vegetables, fruit, seeds and
