Act No. 78-12, to make general provision for workers' conditions of
employment.   Dated 5 August 1978. (Journal Officiel, 8 August 1978,
No. 32, p. 532.)
Introductory provisions
1. The purpose of this Act is to make general provision for workers'
conditions of employment.
As defined in the National Charter and the Constitution, a worker is any
person living from the product of his work, whether intellectual or manual, and
not employing to his advantage other workers for the purposes of his
occupational activity.
This Act defines the rights enjoyed by workers and the corresponding
obligations that they are required to discharge, in either case irrespective of the
sector in which they are employed.
The participation of workers in the life of an undertaking and the system of
management applied in the socialist agricultural sector shall be governed by the
laws and regulations currently in force, and more particularly by those relating
to the socialist management of undertakings, the Agrarian Revolution and the
agricultural self-management scheme.
The provisions of this Act shall not apply to self-employed workers.
2. Model conditions of employment for each sector of activity shall be
patterned on this Act. They shall be issued by decree.
The specific conditions of employment applying to the workers in each
undertaking shall be patterned on this Act and the model conditions of
employment issued for the particular sector of activity. They shall be issued in
regulations after consultation with the trade union authorities.
In the private sector the specific conditions of employment to be applied in
undertakings shall be laid down by collective agreement within the framework
of this Act and the model conditions of employment issued for the sectors of
activity to which the undertakings concerned belong.
3. Workers' employment relationships shall be governed by the general
provisions made for their conditions of employment, the model conditions of
employment issued for the various sectors of activity, the specific conditions of
employment applied in undertakings and the generality of the related laws or
regulations.
4. Work is the essential factor in the economic, social and cultural
development of the nation and the source from which a worker derives his
means of subsistence. Algerian society is based on work. It is governed
by the principle From each according to his abilities, to each according to his
work.
5. It shall be the duty of each worker and each undertaking to give
permanent expression through work to the principle From each according to
his abilities, as laid down in the National Charter.
More specifically-
each worker must be employed and conduct himself in such a way as to make
the best use of his occupational, physical and intellectual abilities;
