in Mauritius during African Commission Meeting

On 22 October 1996, a Coopera-
tion Agreement between the OAU and
the IJ was signed in Mauritius by Dr.
Salim Ahmed Salim, OAU Secretary-
General, and Mr. Adama Dieng, WCJ
Secretary-General. The ceremon'y took
place during the 20th Session of the
African Commission on Human and
Peoples' Rights (ACHPR) which was pre-
ceded  by the    1 1th  ICJ  Workshop
on Participation in the Work of the
ACHPR. Both      meetings were held
in Grand Baj, Mauritius, from 18-
20 October 1996.
The historic signing of the Coopera-
tion Agreement signals a new era in an
already long-lasting bilateral relationship
which can be traced back to the early six-
ties. The Cooperation Agreement recalls
that, in 1961, the ICJ organized a conferen-
ce on the Rule of Law in Lagos in the wake
of the freshly gained freedoms acquired by
the newly independent States of Africa.
The Mauritius document envisages
the holding of joint activities in a host of
different fields. For instance, it specifically
mentions the holding of joint meetings and
conferences, the exchange of opinion and
technical analysis on matters of mutual

interest, including material and financial
assistance, the exchange of information
and documentation, and consultations on
programmes so as to avoid duplication and

ensure maximum harmonisation between
the two organizations. The Agreement
entered into force on the date of
signing.

Anxiety Grows Over Hong Kong's Future
Jurists Call for the Preservation of the Rule of Law in Hong Kong

ICJ President, The Hon. Justice
Michael Kirby AC CIG visited Hong
Kong on 25 October 1996. He met with
representatives of the territory's govern-
ment, the legal profession and members
of the Legislative Council and Executive
Council. This mission constituted a fol-
low-up to the 1991 mission to Hong
Kong   and   its  subsequent report,
Countdown to 1997, published in
1992.
As the countdown continues in Hong
Kong, once again the ICJ voiced deep
concern over what might happen after
1 July 1997, the date of the transfer of

sovereignty over the territory from the
United Kingdom to China. This concern
focused on the maintenance and the pro-
tection of the Rule of Law, respect for
human rights and the independence of the
judiciary. Resolutions designed to ensure
that these are preserved by China were
included in the report of the mission.
Entitled Hong Kong and the Rule of Law,
the report was presented by Justice Kirby
after his visit and made public on
1 December 1996.
The report highlights emerging pro-
blems that have prompted increasing
concern in the last few months. One of the

main concerns was that of the future of
the territory's legislature. The ICJ stressed
that the legitimacy and integrity of the
elected Legislative Council should be pro-
tected and that the attempt by China to
establish in its place an alternative
Legislative Council should be condem-
ned.
The report recalled that the selection
of members of the alternative Legislative
Council by 400 persons, all appointed by
China, was a clear breach of the agree-
ment in the Sino-British Joint Declaration
and the provisions of the Basic Law of
