It's March, the But NCAA Is Yet to
Budge on Legal Sports Betting

I t is hard to believe that as recently as
three years ago-prior to the Supreme
Court's May 2018 decision declaring
that the Professional and Amateur Sports
Protection Act (PASPA) was unconstitu-
tional-Americans seeking to wager on
the NCAA basketball tournament had to
choose between either traveling to Nevada
or wagering illegally, whether with an
offshore provider or local bookie. Remark-
ably, in the time since 2018, close to half
the states, plus the District of Columbia,
have enacted legalized sports wagering.
Several other states have passed bills and
ballot initiatives. Consequently, sports

wagering will likely be active in some form
or another in over half the states by the
end of 2021.
March is a particularly appropriate
time of year to think about what has and
has not changed in the legal sports bet-
ting landscape. This is not only because
the NCAA's annual 68-team tournament
is rivaled only by the Super Bowl as the
top sports wagering event of the year in
the United States, but also because it was
the NCAA itself that served as one of the
main characters seeking to uphold PASPA.

S tacie Stern is often referred to as the First
Lady of Fantasy Sports. The moniker
is well-deserved. After spending 16 years at
Head2Head, she joined FanDuel in 2017,
taking a position in the government affairs
department in 2017. Her rise at the largest
real-money gaming operator in the United
States has been swift, in part because of her
willingness to tackle the hottest topics in
a fast-changing industry. My Legal Bookie
caught up with the Government Affairs
Director to discuss March Madness sports
betting and how it relates to college athletes.

Question: As you travel to state legisla-
tures around the country, what is your goal
at each stop?
Answer: My focus is to help legislators
learn about the current state of unregu-
lated sports wagering so that they have the
information to develop reasonable laws.
Principles such as a mobile, competitive
market with multiple operators as well as an
expansive betting catalog, including allowing
wageringon college sports, are imperative for
success in converting people to a regulated
market. It's important for states to legalize
sports betting so it can be taxed and regulated
