Subject: Nuclear Regulatory Commission: Revision of Fee Schedules; Fee Recovery for Fiscal
         Year 2023

Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major
rule promulgated by the Nuclear Regulatory Commission (NRC) titled Revision of Fee
Schedules; Fee Recovery for Fiscal Year 2023 (RIN: 3150-AK58). We received the rule on
June 13, 2023. It was published in the Federal Register as a final rule on June 15, 2023.
88 Fed. Reg. 39120. The effective date is August 14, 2023.

According to NRC, this final rule amends the licensing, inspection, special project, and annual
fees charged to its applicants and licensees. NRC stated that these amendments are
necessary to comply with the Nuclear Energy Innovation and Modernization Act (NEIMA), which
requires NRC to recover, to the maximum extent practicable, approximately 100 percent of its
annual budget less certain amounts excluded from this fee-recovery requirement. See
42 U.S.C. § 2215 (this section was enacted as part of NEIMA).
