DIGEST
1. Protest of the agency's evaluation of technical proposals is denied where the
protester has not demonstrated that the agency's decision was unreasonable or
constituted disparate treatment.
2. Protest of the agency's decision not to conduct discussions is denied where
solicitation provided that the agency intended to make award without discussions and
no statute or regulation required the agency to conduct discussions.
3. Protest of the agency's best-value tradeoff decision is sustained where the record
reflects that the agency did not qualitatively compare proposals before issuing the task
order to the higher-priced, higher-rated proposal.
DECISION
R&K Enterprise Solutions, Inc., a small business of Newport News, Virginia, protests the
issuance of a task order to Cyber Engineering and Technical Alliance, LLC (CETA), a
small business of Columbia, Maryland, under Fair Opportunity Proposal Request
(FOPR) No. FA4890-21 -R-0001, issued by the Department of the Air Force, Air Combat
Command, for information dominance support. R&K challenges the agency's
evaluation of proposals, the agency's decision not to engage in discussions, and the
agency's best-value tradeoff decision.
