Subject: Department of Health and Human Services, Centers for Medicare & Medicaid
Services: Medicare Program; Medicare Coverage of Innovative Technology (MCIT)
and Definition of Reasonable and Necessary
Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major rule
promulgated by the Department of Health and Human Services, Centers for Medicare &
Medicaid Services (CMS) entitled Medicare Program; Medicare Coverage of Innovative
Technology (MCIT) and Definition of Reasonable and Necessary (RIN: 0938-AT88). We
received the rule on November 16, 2021. It was published in the Federal Register as a final rule
on November 15, 2021. 86 Fed. Reg. 62944. The effective date is December 15, 2021.
According to CMS, the final rule repeals the Medicare Coverage of Innovative Technology and
Definition of 'Reasonable and Necessary' final rule, which was published on January 14, 2021,
86 Fed. Reg. 2987, and was to be effective on December 15, 2021.
The Congressional Review Act (CRA) requires a 60-day delay in effective date of a major rule
from the date of publication in the Federal Register or receipt of the rule by Congress,
whichever is later. 5 U.S.C. § 801(a)(3)(A). The final rule was published on November 15,
2021. 86 Fed. Reg. 62944. The Congressional Record does not indicate when the final rule
was received by Congress. The final rule has a stated effective date of December 15, 2021.
