Subject: Department of Veterans Affairs: Loan Guaranty: COVID-19 Veterans
Assistance Partial Claim Payment Program
Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
major rule promulgated by the Department of Veterans Affairs (VA) entitled Loan
Guaranty: COVID-19 Veterans Assistance Partial Claim Payment Program (RIN:
2900-AR05). We received the rule on May 28, 2021. It was published in the Federal
Register as a final rule on May 28, 2021. 86 Fed. Reg. 28692. The effective date is
July 27, 2021.
According to VA, the final rule establishes the COVID-19 Veterans Assistance Partial
Claim Payment program (COVID-VAPCP). VA states that this is a temporary program
to help veterans return to making normal loan payments on a VA-guaranteed loan
(guaranteed loan) after exiting a forbearance for financial hardship due, directly or
indirectly, to the COVID-19 national emergency.
The Congressional Review Act (CRA) requires a 60-day delay in the effective date of a
major rule from the date of publication in the Federal Register or receipt of the rule by
Congress, whichever is later. 5 U.S.C. § 801(a)(3)(A). The final rule was published on
May 28, 2021. 86 Fed. Reg. 28692. The House of Representatives received the rule
on June 30, 2021. 167 Cong. Rec. H3907 (daily ed. July 26, 2021). The Congressional
