DIGEST

1. Protest challenging the agency's evaluation of awardee's price and technical
approach proposals is dismissed as factually and legally insufficient.

2. Protest challenging the agency's evaluation of protester's business management
approach is denied where the evaluation was reasonable and consistent with the stated
evaluation criterion.

3. Protest challenging the rating assigned to the evaluation of protester's technical
approach is denied where the protester does not dispute the underlying evaluation and
fails to establish that it was prejudiced by the rating assigned.
DECISION

U.S. Facilities, Inc. (USF), of Philadelphia, Pennsylvania, protests the award of a
contract to EMCOR Government Services, Inc. (EGS), of Arlington, Virginia, under
request for proposals (RFP) No. DE-SOL-001 1435, issued by the Department of Energy
(DOE) for facilities maintenance and management services at DOE's headquarters
locations in Washington, District of Columbia, and Germantown, Maryland. USF argues
the agency's evaluation of offerors' proposals and resulting award decision were
improper.


We dismiss the protest in part and deny the protest in part.
