Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
major rule promulgated by the Department of Health and Human Services (HHS),
Office of the Secretary, entitled Health Insurance Reform; Modifications to the
Health Insurance Portability and Accountability Act (HIPAA) Electronic Transaction

published in the Federal Register as a final rule on January 16, 2009. 74 Fed. Reg.

The final rule adopts updated versions of the standards for electronic transactions
originally adopted under the Health Insurance Portability and Accountability Act of
1996. The final rule also adopts a transaction standard for Medicaid pharmacy
subrogation, and two standards for billing retail pharmacy supplies and professional
services. The final rule has an effective date of March 17, 2009, for most provisions
          of the rule.

Enclosed is our assessment of HHS's compliance with the procedural steps required
by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule. Our review
of the procedural steps taken indicates that HHS complied with the applicable
