                  Suppliers of Durable Medical Equipment, Prosthetics, Orthotics, and
                  Supplies (DMEPOS)

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Health and Human Services, Centers
          for Medicare and Medicaid Services (CMS), entitled Medicare Program; Surety Bond
          Requirement for Suppliers of Durable Medical Equipment, Prosthetics, Orthotics,
          and Supplies (DMEPOS) (RIN: 0938-AO84). We received the rule on January 2,
          2009. It was published in the Federal Register as a final rule on January 2, 2009.
          74 Fed. Reg. 166.

          The final rule implements section 1834(a)(16) of the Social Security Act by requiring
          certain Medicare suppliers of durable medical equipment, prosthetics, orthotics, and
          supplies to furnish CMS with a surety bond. The final rule has an effective date of
          March 3, 2009.
