          Subject: Department of Defense, Office of the Secretary. TRICARE; Hospital
                  Outpatient Prospective Payment System (OPPS)

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Defense (DOD), Office of the
          Secretary, entitled TRICARE; Hospital Outpatient Prospective Payment System
          (OPPS) (RIN: 0720-AB19). We received the rule on December 18, 2008. It was
          published in the Federal Register as a final rule on December 10, 2008. 73 Fed. Reg.
          74,945.

          The final rule implements a prospective payment system for hospital outpatient
          services similar to that furnished to Medicare beneficiaries. The rule also recognizes
          applicable statutory requirements and changes arising from Medicare's continuing
          experience with this system, including certain related provisions of the Medicare
          Prescription Drug, Improvement, and Modernization Act of 2003. The final rule
          implements an existing statutory requirement for adoption of Medicare payment
          methods for institutional care which will ultimately provide incentives for hospitals
          to furnish outpatient services in an efficient and effective manner.

          The final rule is effective on February 6, 2009. The Congressional Review Act
          requires major rules to have a 60-day delay in their effective date following
          publication in the Federal Register or receipt of the rule by Congress, whichever is
          later. 5 U.S.C. § 801(a)(3)(A). We did not receive the rule until December 18, 2008,
