                  Administration: Endangered Fish and Wildlife; Final Rule To Implement
                  Speed Restrictions to Reduce the Threat of Ship Collisions With North
                  Atlantic Right Whales

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Commerce, National Oceanic and
          Atmospheric Administration (NOAA), entitled Endangered Fish and Wildlife; Final
          Rule To Implement Speed Restrictions to Reduce the Threat of Ship Collisions With
          North Atlantic Right Whales (RIN: 0648-AS36). We received the rule on October 7,
          2008. It was published in the Federal Register as a final rule on October 10, 2008.
          73 Fed. Reg. 60,173. The rule has a stated effective period of December 9, 2008, to
          December 9, 2013.

          The final rule restricts the speed of vessels 65 or more feet long in certain locations
          and at certain times along the east coast of the U.S. Atlantic Seaboard. The purpose
          of this final rule is to reduce the likelihood of collisions between these vessels and
          North Atlantic right whales. Such collisions can result in the death or serious injury
          to the whales.

          Enclosed is our assessment of NOAA's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that NOAA complied with the applicable requirements.
