          Subject: Department of Health and Human Services; Centers for Medicare and
                  Medicaid Services: Medicaid Program; Citizenship Documentation
                  Requirements

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Health and Human Services; Centers
          for Medicare and Medicaid Services (CMS), entitled Medicaid Program; Citizenship
          Documentation Requirements (RIN: 0938-AO51). We received the rule on July 9,
          2007. It was published in the Federal Register as a final rule on July 13, 2007. 72
          Fed. Reg. 38,662.

          The final rule implements the statutory requirement that states obtain satisfactory
          documentary evidence of a Medicaid applicant's or recipient's citizenship and
          identity. This final rule provides states with guidance on the types of documentary
          evidence that may be accepted.

          Enclosed is our assessment of the CMS's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that CMS complied with the applicable requirements.

          The final rule has an announced effective date of July 13, 2007. GAO received the
          rule on July 9, 2007, and it was published in the Federal Registeron July 13, 2007.
          The Congressional Review Act requires 60 days between the effective date of a major
