                  Program

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Agriculture, Farm Service Agency
          (FSA), entitled Emergency Conservation Program (RIN: 0560-AH43). While our
          Office has not yet received the rule, it was received by the Senate on June 8, 2006,
          and the House received the rule on June 13, 2006. It was published in the Federal
          Register as an interim final rule on May 26, 2006. 71 Fed. Reg. 30263.

          The interim final rule amends the Emergency Conservation Program (ECP) to
          implement the provisions of the Department of Defense, Emergency Supplemental
          Appropriation to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza
          Act, 2006 (Pub. L. 109-149). The rule provides assistance to nursery, oyster, and
          poultry producers and non-industrial private forest landowners to rehabilitate public
          or private oyster reefs or farmland damaged by hurricanes during calendar year
          2005.

          Enclosed is our assessment of the FSA's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that, with the exception of filing the rule with our Office, FSA
          complied with the applicable requirements.
