                  From North Carolina to Reduce Interstate Transport of Fine Particulate
                  Matter and Ozone, Federal Implementation Plans to Reduce Interstate
                  Transport of Fine Particulate Matter and Ozone; Revisions to the Clean Air
                  Interstate Rule; Revisions to the Acid Rain Program

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Environmental Protection Agency (EPA), entitled
          Rulemaking on Section 126 Petition From North Carolina to Reduce Interstate
          Transport of Fine Particulate Matter and Ozone; Federal Implementation Plans to
          Reduce Interstate Transport of Fine Particulate Matter and Ozone; Revisions to the
          Clean Air Interstate Rule; Revisions to the Acid Rain Program (RIN: 2060-AM99).
          We received the rule on March 16, 2006. It was published in the Federal Register as a
          final rule on April 28, 2006. 71 Fed. Reg. 25328.

          The final rule relates to the interstate transport of emissions of NOx and SO2 that
          contribute significantly to nonattainment and maintenance problems with respect to
          the national ambient air quality standards for fine particulate matter and 8-hour
          ozone. The rule contains EPA's final response to the State of North Carolina's
          petition submitted under section 126 of the Clean Air Act. Also, EPA is making
          revisions to the final Clean Air Interstate Rule (CAIR) to clarify certain provisions,
          correct minor errors, and to take final action on reconsideration of the definition of
          electric generating units as it relates to solid waste incinerators.
