          Subject: Department ofAgriculture, Farm Service Agency, Commodity Credit
                  Coiporation: Tobacco Transition Payment Program

          Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of Agriculture (USDA), Farm Service
          Agency, Commodity Credit Corporation, entitled Tobacco Transition Payment
          Program (RIN: 0560-AH30). We received the rule on April 4, 2005. It was published
          in the Federal Register as a final rule on April 4, 2005. 70 Fed. Reg. 17150.

          The final rule provides regulations for the Tobacco Transition Payment Program
          (TTPP), as required by Title VI of the American Jobs Creation Act of 2004 (the 2004
          Act), ending the tobacco marketing quota and price support loan programs. The
          TTPP will provide payments over a 10-year period to quota holders and producers of
          quota tobacco to help them make the transition from the federally-regulated
          program.

          Enclosed is our assessment of the USDA's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that USDA complied with the applicable requirements.
