          Subject: Department of the Interior, Bureau of Indian Affairs: Distribution of Fiscal
                  Year 2002 Indian Reservation Roads Funds

          Pursuant to section 801(a) (2) (A) of title 5, United States Code, this is our report on a
          major rule promulgated by the Department of the Interior, Bureau of Indian Affairs
          (BIA), entitled Distribution of Fiscal Year 2002 Indian Reservation Roads Funds
          (RIN: 1076-AE28). We received the rule on December 20, 2001. It was published in
          the Federal Register as a temporary rule and request for comments on 67 Fed. Reg.
          1290.

          The rule requires distribution of 75 percent of fiscal year 2002 Indian Reservation
          Roads funds to projects on or near Indian reservations using the relative needs
          formula adopted in 1993.

          Enclosed is our assessment of the BIA's compliance with the procedural steps
          required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
          Our review indicates that the BIA complied with the applicable requirements.
