1. Protest challenging assignment of significant weaknesses to proposal is denied
where the record confirms that the agency's concerns were valid because the
protester's allocation of certain costs was contrary to the solicitation's direction.

2. Protest alleging that agency failed to conduct meaningful discussions is denied
where the agency was not required to discuss significant weaknesses that first
appeared due to a solicitation amendment that was issued after the agency conducted
discussions.

3. Protest arguing that awardee impermissibly qualified its fixed prices is denied where
awardee merely identified thresholds for changes in volumetric data that would result in
discussions with the agency, as required by the solicitation.
DECISION

Enterprise Services LLC, (ES) of Herndon, Virginia, protests the issuance of a task
order to CACI, Inc.-Federal, of Chantilly, Virginia, pursuant to task order request for
proposals (TORP) No. HSTS03-16-R-CIO001, which was issued by the Department of
Homeland Security (DHS), Transportation Security Administration (TSA), for information
technology (IT) support services. ES challenges the assignment of two significant
weaknesses to its proposal, objects to the agency's discussions, and asserts that
CACI's proposal impermissibly qualified its fixed prices.
