DIGEST

1. Protest that agency improperly rejected protester's task order proposals is denied
where the protester proposed prices exceeding the prices established in its indefinite-
delivery, indefinite-quantity contract, contrary to the solicitation.

2. GAO will not review a protester's assertion that an agency abused its discretion by
failing to conduct discussions when the solicitation expressly advised that the agency
intends to make award without discussions.
DECISION

ACADEMI Training Center, LLC dba Constellis (ACADEMI), of Moyock, North Carolina,
protests the issuance of two task orders to DECO, Inc., of Champlin, Minnesota, by the
Department of State under request for proposals (RFP) No. SAQMMA1 7R01 63 for
antiterrorism training to foreign law enforcement and civilian government officials
worldwide. The protester contends that the solicitation contained a latent ambiguity that
resulted in the agency unreasonably finding its task order proposals ineligible for award.
The protester further argues that the agency abused its discretion by failing to conduct
discussions.


We deny the protest.
