Subject: Department of Defense, General Services Administration, National Aeronautics
        and Space Administration: Federal Acquisition Regulation; Removal of Fair Pay
        and Safe Workplaces Rule

Pursuant to section 801 (a)(2)(A) of title 5, United States Code, this is our report on a
major rule promulgated by the Department of Defense (DOD), General Services
Administration (GSA), and National Aeronautics and Space Administration (NASA)
(collectively, agencies) entitled Federal Acquisition Regulation; Removal of Fair Pay
and Safe Workplaces Rule (RIN: 9000-AN52). We received the rule on November 6,
2017. It was published in the Federal Register as a final rule on November 6, 2017.
82 Fed. Reg. 51,527. A correction which does not affect our report was published on
November 8, 2017. 82 Fed. Reg. 51,773.

DOD, GSA, and NASA are issuing this final rule amending the Federal Acquisition
Regulation (FAR) to implement a public law that disapproved the final rule, Fair Pay and
Safe Workplaces (FAR Case 2014-025), and an executive order dated March 27, 2017,
that rescinded the prior executive orders authorizing that rule.

Enclosed is our assessment of the agencies' compliance with the procedural steps
required by section 801 (a)(1)(B)(i) through (iv) of title 5 with respect to the rule. Our
review of the procedural steps taken indicates that the agencies complied with the
applicable requirements.
