Dear Mr. Chairman:

In your letter of July 27, 1991, you requested that we review
expenditures made by the United States Marshals Service for
remodeling office space and issue an opinion on whether
Marshals Service Director K. Michael Moore had violated
section 614 of Public Law 101-1361/ with respect to these
expenditures. Section 614 limits to $5,000 the amount that
may be used to furnish or redecorate the office of a
presidential appointee without specific approval from the
Committees on Appropriations of the Senate and House of
Representatives. With your letter you provided a copy of an
Associated Press news story discussing the remodeling work
done at the Marshals Service headquarters.

Upon receipt of your letter, we asked Director Moore to
provide us with a report on the remodeling and his
interpretation of section 614. We also physically inspected
the Marshals Service facilities. For the reasons indicated
below, we conclude that in authorizing the remodeling of the
Marshals Service offices Director Moore did not violate
section 614.








1/In your letter you actually asked whether section 614 of
Public Law 101-509, the fiscal year 1991 Treasury-Postal
Service appropriation act, was violated. However, since the
questioned remodeling was funded with fiscal year 1990
appropriations, we addressed the identical provision (also
section 614) in the fiscal year 1990 appropriation act, Public
Law 101-136
