     Dear Mr. -Chairman:
          Your letter dated March,-2, 1978,.requestedour comments on

     S. 2582, -95th Congress, which, if enacted, .wouldbe.- cited :as the-
     National-Aquaculture Organic-Act.- A generally similar bill,
     H,R, 9370, was passed .by the.House of Representatives on .Febru-.. .
     ary 15, 1978.

          The purpose of bothS. 2582 and H.R.: 9370- is to promote aqua-
     culture in- the United States .by (1), declaring a national aquacul-
 -   ture policy; (2)establishing and implementing- a national; plan
 .   for aquaculture; and..(3) developing.programs and encouraging ac-
     tivities which will. .result in the .coordinaton0f domesticaqua-
     culture-efforts, the -conservation, and increased availability of
     fisheries resources, the. creation of :ew industries and-job.
     opportunities, and. other national! benefits.

          Section 7(b) of each bill ,would authorize the Secretary to
     prescribe regulations relating to .contracts and grants and sec-
     tion 7(d) of each bill-would require any..person 'who receives a'
     grant or contract tomake available to .the Secretary and to the
     Comptroller General.of the United.States,'. or. any. of their-autho-
     rized representatives,-- for-purposes-of audit and examination,. any
.    book, document, paper,- and record that .is pertinent -to. the funds6.
     received under such grant or.contract.    .

          We believe these pro.visions could :result.-in future audit
 *   and/or access to records problems.because.:,section, .7(b).. does not
 *   specify the types of records that -recipients. should maintain and'
     section 7(d) is not. clear as to.who.would..make the. determination-
     whether books, documients,,* paper,' :and record  are irelated to the.
     grants or contracts. -We believe -adequate :ptovisions .relating: to
     maintenance and access:.to records also.shoUld be included with.
     respect to. the financial assistance:authorized :under. sections 8, .
  S  9 and 10 of both.-bills. and- section -11. of:*J4R.- 93-70. . To avoid
