DIGEST

1. Protest that a commercial shelter modified to agency specifications is no longer a
commercial item is denied, where the shelter, as modified, is offered for sale to the
public on the firm's website.

2. Protest that the agency improperly decided to award a sole-source contract is
denied, where the agency reasonably determined that the protester could not have its
product tested in time to meet the agency's fielding schedule.
DECISION

Gichner Systems Group, Inc.,1 of Dallastown, Pennsylvania, protests the decision of the
Department of the Army to award a contract on a sole-source basis to AAR Mobility
Systems (AAR),2 of Cadillac, Michigan, under request for quotations (RFQ)
No. W9098S-17-T-0014 for shelters for the petroleum quality analysis system -
enhanced (PQAS-E). Gichner challenges the Army's determination that AAR's shelter
