Dear W. 8aMson:

     Reference is made to letter dated October 25, 1972, with enclo-
sure,, from the General Consel, rquestIng a decision ao to the. ae- a
to be taken concerning an error allegtd by the Tuner CcuWt to have
been made in its bid upon which contract No. G-,6-7007 vas based.

     The Procurement Division, Federal Supily Srvioe, General Services
Administation (M), Kansas City, Missour, by Invitation for bids
No. 6PR-W-04081-CK-F reqtated bids. for tmwiahing 132 liquid fuel fire
pots. The Turnr Cmnzy submuitted the only bidt in the anmut of $28.44
per unit. The bid of the company was aocept   on  arch 23, 1972.

     It is reported that on Jwie 19, $72, TuTre's reosentative tele-
phned the contracting officer alleging that the c*apwny had mde a mis-
take in its bid on the fire pots and staed that heo V  first aware of
the mistake at the time a ther GSA contracting ofieer caled bim and
questioned the cmpa y'a, bid. of $4.3.83 for the same it-em.

     In a letter dated June 21, 1W, Tumer -stated thwt it had ero-
neously based its bid price on fuzniuhdng Its mdel T-20 guoline fire
pot rather than on fuxishirng fte propane fire Pot required by the spec-
ifications and that th require& fire pot omists of five components,
the total cost of which is n43-. 14 support of its allegation of error,
the ecca    sitmitted its printed pree list hieh shows the coa of each
of the five caqpmts needed fmr the amse ly of the reqvived fire pot.
Tuner  so stnmitted copies of two invoices which it had sent to GOA for
fire pots similhr to those requred by the sJeet solieitxtin. The
invoices show vnit Vrices of $40 and 02.05, reseotively.

     On the basis of the record it appears that Turner mde a mistake in
its bid. However, in requesting eeretd     of the mistak., Turnr doea
not seek to have the bid corrected so as to have included therein a pre-
viously  alculated item tAih was inadv4rtently aaitt   from the amunt
of the original bid. Bather, Turner ppopm to Turnish a. different mode
fire pot than the one it based its bid upo and to increase the bid by an
eamunt rr-sentin the difference in prie between the two models.

     In 17 Ch Con. 575 577 (1938), It was stated:
