Dear Mrs. Ioward:

     Ve refer to your letter dated October 17, 1972, with enclosures,
requesting our decslon as to whether a reclaim voucher in the amount of
$392.30 in favor of                      an employee of the Department
of Transportatlon, may be certified for payment in view of the circum-
stances hereinafter described .

     The record indicates that under Travel Authorization No. TS 20312,
dated Septattber 23, 1971,          was authorized a chanre of official
duty station from Naahington, D. C., to Seattle, ashitOn.

     Upon completion of the subject transfer,           sabuitted
vouchers for the relabursement of those costs incurred incident to his
move to Seattle, Washington. In the administrative processing of the
vouchers there as suspended therefrom, Intier ali, the amount of
$392.30. Such amount is nOw being cli-md byS in the present
reclati voucher.

     The $192.50 now being sought for reimburse net appears to onstitute
a loan origination fee which a lending Institution is allowed to charge
for processing a loan under regulations of the Veterans Admiistration
(also referred to as a VA funding fee) and $10 for a tax registration
charge. With regard to the former, we note that the $382.50 fee was
described as a fBank Loan Fee' on the settlement sheet dated January 24,
1972, which w*as Issued by the ashington Mutual Savings Bank (the lender)
at the tm*e of settlement. on a nto residence in Belleavue, 'Washington
urthenore, it i. noted that the $382.50 fee charged by the bank was
exactly 1 prcent of the loan amount involved.

      Anjjiof acespondene        ttached to the reclaim voucher reveals
that           apparently feels that reimbursement of a loan oriaination
ftee (VA funding fee) is not prohibited by the eontrolling reaglations,
that is, Office of M-amaement and  tde.get (OM) Circular No. A-56, revised
August 17, 1971.
