 Dear Senator Bumpers:

     This is in further reply to your June 19, 1978 letter in
which you asked that we review certain language that was agreed
to by the Committee on Energy and Natural Resources concerning
the Clinch River Breeder Reactor (CRBR) project. On June 20,
1978, this language was adopted by the Committee as sections
105 and 106 of S. 2692, the Department of Energy Civilian
Program Authorization Act for Fiscal Year 1979. You asked:

     1. If the language clearly authorizes the Administra-
     tion to take all necessary actions to terminate the
     CRBR project except for completion of the systems de-
     sign and the testing of certain components;

     2. If the Administration does terminate the CRBR pro-
     ject, what will be the status of the authorization under
     section 106 (of Pub. L. No. 91-273, the CRBR project
     authorizing legislation);

     3. Whether the Administration is mandated with this
     language to proceed with the construction of a new
     reactor project even if the new design is considered by
     the President not to be in the national interest; and

     4. If the CRBR project is terminated, what amounts, if
     any, will have to be spent and for what purposes under
     section 106, if the staff language is adopted.

     In his June 21, 1978, letter, our General Counsel informed
you that we could not, at that time, provide you with responsive
answers to your questions. He noted that certain portions of
the CRBR project language appeared ambiguous and that without
the benefit of a Committee report or other legislative history
to resolve some of the questions, we could not meaningfully
construe those parts of the bill's language.
