Dear Wf.  eter:

     This refers to your request for an advance decision on the avail-
ability of funds expeted to be realized by the sale of obsolete equipment
and fixtures, for the purchase of new scietific eqipmet and fixtues,
by the National Center for Toxicological Research (MM0Tt) at Pine Iuflu,
Arkansas. Formal decisions are generally provided only to heads of
&gtcios or to ertifyUg or disbursitg officers who mbmit ia vouhear
hich they are not certain should be paid. However, pebspa the folowf:
information will be helpful.

     You explain that UT. has several Idle facilities formerly used for
research and development of biological earfare products, to be enwverted
into laboratories and related space for research essential to food, drug
and chemical safety. Contracts vere being entered into for having two
buildings stripped vitlhout cost to the Government for the salvage value
and an additional $350 to $400 thousand dollars. 3M    wants to apply
thee funds to the purchan of scientific equipment for istallation in
the renovated facilities. The Pood and Drug Admtuistatton is in accord
vith the use of the funds for that purpose but desires GAO onfirmatioa
on the propriety of their use.

     You cite section 15.A4/f title 7, GAO Policy and Procedures Mtnual
for the Guidance of Federal Agencies, which provides that Bcept as
Otherwise di ected, all proceeds from the sIal of personal property will
be available * * * for the purchase of replace nt propert ,.   Further,
the MAal provids that f the sale proceeds are not applied to replace-
ant purebases, the proceeds vill be deposited in the Treasury as mis-
c!llaneotu receipts in the general fuud.
