     This is in response to a request for an advance decision from an

 L. No. 95-217, 91 stat. 1566, 1606. For the reans set forth below,
 we fad that, without a clearer basis to *omelude that a private
 persea easgging in the se s activity planced by the Forest Service
 would be subject to a State requirement governing the disc#hrge of
 dredged or fill magtetis, the permit fee may mm be paid.

     The Forest Service plans to t 4  truet an impovndment to create
 a wildlife flowage is the Chequamengo National Forest (Chequanlon)
 on the Eest Fork feeder to Lyach Cresk in Sawyer Conty, tseonsla,
 This e oustrction will create a wetland where   amepreviously existed.
 As i result of this ooastraetioe, iseldtal discharges of dredged
 and fill material may flow into Lynak Croik.
