DIGEST:


Employee who claims retroactive temporary promotion
with backpay for detail to higher-level position is
not entitlerto retroactive temporary promotion with
backpay because position in question was abolished
within 120 days of start of detail.


     Mr. Kenneth J. Wood, through his duly authorized representative,
has appealed our Claims Division's disallowance of his claim for a
retroactive temporary promotion with backpay.

     Mr. Wood, employed by the Department of the Army as a
Warehouseman, WG-6907-5, claims a retroactive temporary promotion
to Warehouse Supervisor. WS-3, step 5, for an alleged detail from
September 9, 1977, to January 15, 1979. The Army reports that the
Warehouse Supervisor position to which Mr. Wood states that he was
detailed was abolished in November 1977, which is within 120 days
from the start of the detail. We have held on several occasions that
an employee is not entitled to a retroactive temporary promotion for
performing higher-level duties of a position which is no longer
classified and established because it has been abolished. Katherine

     Since Mr. Wood was not detailed to an established, classified
position for more than 120 days, there is no authority to grant him
a retroactive temporary promotion with backpay. Therefore, the
disallowance of his claim is sustained.
