An employee attending a training course at ar
installation of the uniformed services is not
entitled under subparagraph C1055 of 2 Joint
Travel Regulations (2 JT.) to the quarters
portion of the per diem allowance authorized
by 5 U.S.C. 5702(n), where adequate Government
quarters are available but not used. Further,
tinder C1055-1 ite 2 and C1055-2 of 2 JTR, in
the absence of a statement ef the commanding
officer responsible for the Government quarters
that utilization was impractical, or nonavaila-
bility can be ascertained, it shall be assumed
that adequate quarters were available.


     This action is in response to a letter daced May 10, 1978,
with enclosures, from the Accounting Ind Finance Officer, Defense
Logistics Agency Adminiutrative Support Center, Alexandria,
Virginia, submitting a voucher and requesting an advance decision
concerning a claim of Mr. Ronald Miele for payment of commercial
quarters while on temporary dury (TDY) attending the Cost Accounting
Standard Workshop at the United States Logistics Management enter,
Fort Lee, Virginia, from April 10, 19711, through April 2], 1?78.
This request was assigned PDTATAC Control No. 78-25 and forwarded
to this Office by the Per Diem, Travel and Transportation Allowance
Committee.

     The submission states thtat althougi Government quarters were
available at Fort Lee, Virginia, Mr. MLele refiesed to accept
these quarters because he considered them substandard and their
ccidition unsatisfactory. lie did not btain a certificate of
nonavailabiliteof adequate quarters, hur. obtained commercial
quarters rather than use those .ssignred. The travel voucher sub-
mitted by him attaches a statement by Coon l John1 B. Nelson,
Director, Procurement and Production of the Administrative S'pport
Center that 'use of the assigned quarters would have adversely
affected Mr. Miele's ability to attend and complete the training.
However, the Accounting and '-'inance Officer believes that this
Statement cannot be used in lieu of a statement of nonavailability
