                            MATTER OF:       Foreign Service - Travel Expenses on IPA
                                             Assignments
                            DIGEST:    1.  The travel and transportation expanses of Foreign
                                           Service personnel incident to details made pun-
                                           suantto  the Intergovernmental Personnel Act are
                                           payable only  hsdora'r as authorized by 5 U.S.C.
                                           3375(a), aha that portion of the Federal Travel
                                           Regulations which implement the provisions cited
                                           therein.

                                       2.  Where Foreign Service personnel recdive permanent
                                           changes of duty station and Intergovernrmertal
                                           Personnel Act assignments,travel and transpcrla-
                                           tion expenses incident to the permanent changes
                                           of duty station are payabl, under the Foreign
                                           Jervice Travel Segulations and travel and thans-
                                           portation expenses incident to the IPA assisn-
                                           ments are payable pursuant tc 5 U.s.C. 3375(a).

                                This action concerns the request of Daniel L. Williamson, Jr.,
                           Deputy Assistant Secretary for Budget and Finance, Department of
                           State, for An advance decision concerning the proper authority
                           for reimbursemant of the travel and transportation expenses of
                           Foreign Serico  personnel assigned to universities or to state and
                           local governihnts under te  Intergovernmental Personnel Act (IPA),
                           5 U.S.C. 3371-76 (1976).
                                The request shows that the Department of State is'ip the pro-
                           cess of assigning Foreign Service personnel, some of whom are now
                           located overseari, to IPA assignment? within the United States.
                           Pursuant to 22 U.SC.-1136  (1970), the Secretary of State has
                           *ieen given the autho~ity to issue regulatfrunsgovitrning the
                           travel and transportation expenses of Foregn  Service personnel.
                           1i accordance wiH  this authori'y the Secrotar  has promulgated
                           Foreign Service Travel Regulations (FS'.q) whic are published in
                           Volume 6 of the Foreign Affairs  anual.  Thosqj regulafions provide
                           for coverage of viriinally all foreign aid dowestic travel of
                           Foreign Service personnel ant' their families' 6 FAM '11
                           (August 14, 1973).  However, the IIPA specifscally authories pay-
                           ment of certain travel expenses 'pursuant to chbpter 57 of title 5
                           of the United States Code, and these provisions ar& implemented
                           by the Federal Travnl Regulations (FTR) (FPNR 101-7  May 1973).
