  MAA'T'TER OF: MEMCOM Reconsideration


  DIGEST:

     Prior decision, holding agency properly rejected
     as late bid sent by registered mail less than 5
     calendar days prior tro bid opening and received
     day after bid opening, ic affirmed notwithstand-
     ing protester's assertion that IFB was only issued
     4 days prior to bid opening, since agency reports
     that IFB was issued and mailed to protester more
     than one month prior to bid opening.


     MEMCOM requests reconsideration of our decision
a-191526, April 6, 1978, wherain we held that the
Federal Aviation Administration (FAA) properl rejected
as late MEMCOM's bid which was sent by registered mail
less than 5 calendar days prior to bid opening and was
received after bidi opening.

     As grounds for reconsideration, MEMCOM asserts
that the invitation for bids (IFB) %.as issued on March 17,
1978, only 4 days prior to the March 21, 1978, bid opening
date, making it impossible for MEMCC4 to submit its bid 5
days prior to bid opening.

     We have been informed by the FAA tha: the IFB was
synopsized on January 10, 1978, and issued and mailed
to bidders, including MEMCOM, on February 17, 1978.
Accordingly, we do not understand the basis for MEMCOM's
assertion and find no basis for further reconsidering
the matter.  The prior decision is affirmed.
