:  Clark Edwards - Cost of.,Living Allowances

Civilian employee of U.S. Army stationed
in Hawaii, whose cost of living allowance
(COLA) is being phased 6ut based on 1976
survey by Civil Service Commission, claims
backpay and restoration of alowance.
Pursuant to 5-U.S.C S 5941 and Exedutive
Order No. 10000, as amended, Commision
has responsibility of admini iterin4'COLA,
including establish Ig of proper rates of
payment.  Action takeIn was i-accordance
wit  regulations iss ued by the Commission
at 5 C.F.R. 5 591.208 and 5 C.F.R. 5 591.213.
Claim may not-be allowed.


     This decision concerns the request of Major D.E. king,
an authorized finance and accounting officer of the Depart-
ment of the Army, on the claim of Mr. Clark Edwards, a ci
vilian employee of the U.S. Army rngineer Division at
Fort Shatter, Hawaii,.for backpay from Che period December 12,
1976, to the&rdcen t, representing the phasing out and
eventual discontinuance of his cost of living allowances
(COLA). Mr. Edwards also requests restoration of his receipt
of COLA.

     The record shois that Mr. Edwards resides in Kailua,
Hawaiion   the Island of Oahu. Mr. Edwards is entitled to
Department of Defenar- commissary and .post exchange (PX)
privileges.  The'only linitation on these privileges is that
Mr. Edwards is not entitled to purchase articles of the
military uniform.

     On December 29, 1976,. Mr. Edward3 was informed by the
U.S. Army Civilian Personnel'Office tJ'ut uider the Civil
irvi6e  CommisCion (Commission) standrds set forth in
F~deral Personnel Manual (FPM) Letter No. 591-16,
November 15, 1976 (see also FPM Letter No. 391-17,
November 19, 1976), he would not be entitled to c~ntinued
payments of COLA and that such payments would gradually be
phased out in accordance with the Commission's instructions.
