            DIGEST:   Civilian employee of Department of Comerce,
k .                   who transferred from Boulder, Colorado, to
                      Washinbton, D.C., a desigaated high'rate
                      geographleal area, and v- authoriped and
                      performed a househunting trip for a period
                      of 6 days, is entitled to reimbursement at
                      maxiwum statutory par diem rate of $35.
                      Employee is not entitled to daily rate of
                      $50 designated for temporary duty travel in
                      Warhington, D.C.r a high rate geigraphical
                      ara,  since reimbursoment un:der high rate
                      concept is not applicable tu travel in
                      co:i.vaction with a permanent change of
                      station which includes a househunting trip.


             This action arises in response to a requcfl dated-August 25,
         1977, from Ms. Emma Axline, authoUrized certifying officer, National
         Bureau of Standards (NBS), United States Department of Commerce,
         for our aavance decision as to tho ra;e of per 6iem that may be
         authorized Mr. Walter J. Stevens an employee of the agency,
         incident ' a househunting rip ii' Gai.theraburg. Maryland, by
         Mr. Stevens and his wifE'fru  *y 19 through 24, 1977, as authorized
         by travel vrder number 1:131.  the travel order authorised the
         maximum per diem rate.

             The. reccrd discloses that Mr. Stevens was transferreil from
         Boulder, Co]oradc, to Washington, D.C. He was paid 'per diem
         expenses by NBS at the.drily rate of $35, the maximuu statutory
         per diem payable. The claimant feels that he should have beer paid
         per diem of $50, the prescribed maximum daily rate for all locations
         within the corporate limits of Washington, D.C., a designated high
         rate geograpl3ial area, which includes Monogomery County in whicn
         the city of ithersburg  is located. Paragraph 1-8.6, Federal
         Travel Regula tions (FTR) (FPMR 101-7) May 1, 1973, as amended by
         Temporary Regulition A-11, £dpplement 3, Attachmcnt A. The basic
         issue therefore is whether expenses incurred by Mr. Stevens during
         his househunting trip in the Washington, D.C. metrcpolitan area
         are reJimbursable at the $35 maxhmum statutory per fliem rate or at
         the $50 per diem rate precribed for the corporave limits of
         Washington, D.C., as a igh rate geographicl arna.
