         Reconsideration was requeste   of a decision in
connection with a claim by 'he Soil Conservation  Service against
the Small Business Admtnistration  (SBA) for excess costs of
reprocurement following a contract terminated  for default. The
decision was affirmed that a contract  waw in existence between
the agencies. In spite of a pending appeal, the  merits of the
claim Mere considered since no material  facts were disputed ana
the contractor, SBA, requested a decision.  SBA was not found to
be liable for excess reprocurement costa  since it had met its
