Sondra L. Jacobs - Compensation for Holiday
Not Worked


Employee was in leave-without-pay status
from 1030  a.m. December 24, 1975. through
430  p.m. January 2, 1976. She claims
compensation for December 25 and 26, 1975
holidays.  Federal Personnel Manual
Bulletin 610-25, December 15, 1975, states
that employee who I- in nonpay status
before and after holiday is not entitled
to pay for that holiday. This rule, which
is baed  upon decisions of accounting
officers, applies here. Stice employee
was.not in pay status at either close of
workday preceding holidays or at beginning
of workday next following bolidays, she
is not untitled to compensation for such
holidays.


     Sondra L, Jacobs appeals thq Cenial of her claim *or 2 days'
compensation -!or holidays not worked1 which was denied by Claims
Division Settlement 2-2621958, May 18, 1976.

     Mrs. Jacobs is an eployee of the General SezvicLS Adminiatra-
tion (GSA) who, upun exhaustion of her annual and sickleave
balancea, was placed in a leave-without-pay status effective
10:30 am.,  December 74, 1975, and renamied in such status through
430  p.m.. January 2, 1976, for the purpose of takiug a vacation.
In order to receive compensation for holidays of December 25
sad 26, 1975, authorized in ExecutivE Order 11891, December 15,
1975, Kra. Jacobs sought advice from her supervisor as to how to
obtain entitl-lenent to compensation for those days. She was
advised to vork 2 hours on December 24, 1975, and, accordingly,
worked from 8 a.m. to 10 a.m. on that day.

     Subsequently, however, GSA denied Iher claim for holiday pay
for December 25 and 26, 1975,. on the basis of 'aragraph e of the
attachment to Federal Personnel Manual (FFM) *  2tin No. 610-25,
dated December 15, 1975, exLuSing Federal Empwuyees xrom Duty on
Friday, December 26, 1975, which, in pertinent part, states%
