     This action is in response to a lotter dated¶August 8, 1976,
from Mr. John C. Ssall, a former member Z the United States Army,
which in seect  comuitutas  a appeal from a settlement by the
Claim  Divisio  o.? this Office dated July 23, 1976. That settle-
ment disallowed the forme mber's   claim for reimbursement of tei
eosts tar tramaportation c! sae 4,200 pounds o& his personal
property incident to his separation from the Army.

     The record InCieates that the claimant vas separstal from the
Army Ia the arade of captain in June 1972 while stationed in
Saigon, Vietnam, but remained in Vietnam in a civilf.an capacity.
During the peiod that the chimant  was a member of the Army
serving in Vietnam, the Department of the Army's policy prohibited
shipment of hessehold goods for personnel assigned there. Upon
return from Vietnam, an Army member was authorised shipment of his
full   aeempauied baggage allowanee and any professional papers,
boeks. and equipr.at rsquired in the paeiformance of his official
duties.  In aidiclos, mjr  oversea AnrIa comanders were
autheriaed to approve return shipment of personal property in
aeems  of the baggage aflowance on an individual basis when cir-
euastanees existed which warranted approval.
