Employee  of Internal Revenue Servies (.11S)
was assigned to temporary duty in Arlmton,
Virginia, a designated high-rate geographical
area. le occupied lodgings in' : ston, Vir ginia,
which was outside the high-rate area at the ti -
and lie commuted to his temporary duty station.
The employee  may not receive per diem as he
requested since paragraphs 1-8. lb and 1-8, 6
of Federal Travel Regulations (l1iPM1R 101-7),
Temp.  Reg. A-11, May  19, 1975. provided
that when an employee tr8avels to a designated
high-rate geographical area lie shall auto-
matically be reimbursed on an actual-expense
basis.


    I his decision is in response to a request dated July 24,
1975, from Als. Virginia G. f.eist, an authorized certifying
officer, concerni'ig the propr ety of paying per diem to
Mr.  John D. Sanimon, an employee of the Internal Revenue
Service (iRS), for a period of time during which he per-
formed  temporary duty in a locality designa'.ed as a high-rate
geographical area.

    Mr. Sanimon,  whose official duty station is Cleveland,
Ohio, was assigned to attend an official tr aining assitnent
at the ITIS's training conter in Arlington County, Virgini,
starting June 9, 197). On Junu 30, 1975, 1\1r. Sammon submit-
ted a voucher claiming reimbursement of per diemi1 expenses of
$31 a day ft om June . to June 30, 1975. Mr. Sammon
also claimed $1. 80 a day ft the round-trip bus fare from his
lodgings to the traIinirng c' nter. The VOUCheIr was disallwed
on the basis that, since Mr. Sanmon's temVporary duty station
was Arlington. Virginia, a designated high-rate geographical
area, the Feder al Trca.vel aIegulations (PPAlI 101-7) (Temp.
Reg. A-11,  May 19, 1975), only allowed reir:mursuiment on an
actual-expense 1 is.  Acc'rdingly, Mr. Sarmmon  was asked
to submit receipts for the cost of his lodgings and meals anid he
was told he would be reimbursed for such costs up to $42 a day.
