     Tour letter of '%y 9, 1960, acknoledged  May 10, requests
our report on 3. 3491.

     The bill would repeal that part of the act of MAarch 2,
189,  as amended, 40 U.S.C. 2A,  which requires that in the
procurement of sites for publio buildings it shall be the duty
of the Attorney General to require grantare to furnish, free
of all expenses to the Govermaet,  all requsit   abstracts,
official certifications and evideness of title that he maW
dee  necessary.  fhe cited statute applies only to site
acquired tor publie buildings, wich  sites it is understood
represent only a  mall percentage of the number  and value of
-overnment acquisitions.  7he statute does not apply to sites
uhich are not to be used for public buildings, such as sites
for  military reservations, defens requirements, flood-control
and reclamation projects, 7eterane Adaiistration  facilities,
national forests and other AMlar   i-overnmnt acquisitions.
1ith respect to sequisitios  of this latter type, it has been
the universal practice for years to  ay the costs of abstracts
and other necesary  title evidence from the appropriatios
available for the acquisition of the sites, stOpt  ibers the
sites are acquired by  cademation  in which eent  the cost of
nrocuring title evidetce is gemrally  regarded as part of the
expense of the condanation  preceedings sad, therefore, far
;ayment out of the appropriations for the :epartment of
Justice.  7n the event of enactment of 3# 3491p in situations
hnere sites are acquired by direct purchase 'ram the osers,
the appropriation. available for sech acquisitions or the
contingency appropriations of the acquiring agency  in  be
