          Mr dear 'ir. Secretary:

               I have your letter of April 34, 1943, as follam:

               For the occupany  and use of National Forest land for the con-
          aruction, operation and aistenance of eleotric power tranandesion
          lines, the Forest Service grants revocable perite and the Depart-
          ment grants eaAntse Also,   acting uer   the provisions of the
          Federa  Power Act, th Departnt  prescribes certain conditions
          deemd  neesary  for the adequate protection and utilisation of the
          National Foresta; such conditions are made a part of the license
.         granted by the Federal Power Comission.

               The transmission lines through setting up induction often
          interfere with the proper functioning of telaphone lines or radio
          instalstions constructed by the Forest Service from its appropri-
          ation or of private facilities utilised by the Forest service in
          adanistering the National Forests or other land under its juris-
          diction.  Uemoval of the indctie interferene  could be acoomplished
          (a) by relocation or alteration of the perdtted structure (b)
          through relocation of the Governaant-owned facility, or (oS in some
          cases by reconstruction or alteration of the Goverment facility,
          such as converting a ground circuit telephone line into a mtaflto
          airondt line. In mny  cases the Goverent  facility is in existence
          before issuance of permit covering the permitted structure, but
          occaionally a Governmat  telephoe line or other facility is com*
          atrated suewquent  to issuance of permit and/or construction there-
          under.  The coat of relocation or reconstruction of the Governmnt
          atructure my be many times the annual revenue from the peradtted
          structure; for exampe, the charge for a permit authorising the
          occupancy and use of national forest land for a transmission line
          may be 4 15 .00 a year and the relocation or reconstruction of the
          Government facility with which it interferes may cost 300. For
          som  permits, such as those to ;ooperative organizations of farmers
          for transmission lines, no charge is made, although construction of
          the permdtted line may necessitate a substantial expenditure either
          tWGrent-or-byhe-permitteeocorrect-itef                  ee
          the Government facility caused by the transmission line. In all
          cases of license, a rental charge is made.
