Sirs There has been considered your letter of December 21, 1937, FA 125*9541/36, replying to offtie letter of December 10, 1937. relative to the teaure under lease S-356-fa-2, entered into an February 12. 1932p for the Secretary of State by the Anerican Consul at'Tunis, Tunisia, and Mrs* J. Lachaums as agent for Mrs. Henry-Eaymond Malinet for the quarters oseupied by the American Consulate at Tunis* With respeot to the tenure the lease provides as follows The present lease is based on the Gregorian year. The lease is made for ono year to begin January 1, 1932, and to and December 31s 1932. 124 however the notice of leaving is not given by letter or other method, by one or other of the two contracting parties at least three months previous to the expiration of the lease, the lease will be valid under the same oanditions and clauses for another year or until notioe of leaving has been detiitely given. This notice can be &iven by a simple registered letter. It has long been held by the accounting officers and the courts, that a lease to the United States for a tons of years is binding upon the Goverment only to the end of the fiscal year then current, with an option in the Goverment to renew fran year to year until the end of the term, subject to appropriations being made available therefore See seotiona 3679 and 3732, Revised Statutes, as amendedar
